Terms & Conditions

These Terms and Conditions ("Terms") govern the business relationship between SC10 Academy (the "Academy") and clients, participants, and/or their parents or legal guardians ("Client"). By purchasing a session, package, or subscription, or by participating in any Academy program, the Client agrees to be bound by these Terms.

These Terms should be read alongside the Academy's Waiver and Release of Liability and Cancellation & No-Show Policy, both of which are incorporated into these Terms by reference. Where those documents address a specific topic (e.g., physical injury liability, cancellation fees, package expiry), those documents govern; these Terms & Conditions address matters not otherwise covered.


services offered

The Academy provides soccer training and related fitness services, including but not limited to Initial Assessments, Private sessions, Semi-Private sessions, and Small Group sessions, offered on a pay-as-you-go basis or through session packages and subscriptions. Session availability, pricing, and formats may change from time to time at the Academy's discretion.


payment terms

  • Payment is due at the time of booking unless otherwise agreed in writing.

  • The Academy accepts payment methods as made available through its booking platform.

  • All prices are listed in Canadian dollars. Unless otherwise stated, applicable taxes (including GST) are charged in addition to the listed price.

  • By purchasing a package or subscription, the Client authorizes the Academy to store payment information on file for future charges related to that package or subscription, including any fees arising under the Cancellation & No-Show Policy.


refund policy

  • Clients may request a full refund on a session package or subscription within 48 hours of purchase, provided no sessions from that package have been used. Requests made after 48 hours, or after any session has been used, are not eligible under this window.

  • Outside of the 48-hour window described above, session packages and subscriptions are non-refundable, except where required by law.

  • Unused sessions remaining at the expiry of a package's validity period (as set out in the Cancellation & No-Show Policy) are forfeited and are not eligible for a refund or extension, except at the Academy's sole discretion.

  • No refunds are provided for sessions missed due to late cancellation or no-show, consistent with the Cancellation & No-Show Policy.

  • If the Academy cancels or is unable to provide a scheduled session (e.g., due to coach unavailability, facility closure), the Academy will offer a make-up session or credit at its discretion; this does not constitute a right to a cash refund.


payment disputes and chargebacks

If a Client has a concern about a charge, the Client agrees to contact the Academy directly to resolve the matter before initiating a chargeback or payment dispute with their bank or card issuer. The Academy reserves the right to suspend a Client's account or access to future bookings while a disputed charge is unresolved, and to charge an administrative fee to recover costs associated with an unwarranted chargeback, where permitted by law.


Service changes

The Academy may, at its discretion, change coaches, session formats, training locations, or scheduling without prior notice, provided the overall level of service is not materially reduced. Where a change is material (e.g., a change in primary training location), the Academy will make reasonable efforts to notify affected Clients in advance.


conduct and right to refuse or terminate service

In addition to the Code of Conduct set out in the Waiver, the Academy reserves the right, at its sole discretion, to suspend or terminate a Client's participation in Academy programs, without refund, in cases of repeated or serious violation of the Code of Conduct, non-payment, or conduct that the Academy determines poses a risk to staff, other participants, or the Academy's operations.


data & privacy

The Academy collects personal information from Clients, including contact details, emergency contact information, relevant medical or health information, and payment information, for the purposes of providing services, ensuring participant safety, and administering billing.

  • This information will not be sold to third parties.

  • Information may be shared with staff or contractors directly involved in delivering services (e.g., coaches, emergency responders) as necessary.

  • The Academy takes reasonable steps to protect Client information but cannot guarantee absolute security of data transmitted or stored electronically.

  • Clients may request access to, or correction of, their personal information on file by contacting the Academy directly.


eligibility

Participants under the age of 18 must have these Terms, the Waiver, and the Cancellation & No-Show Policy agreed to and signed by a parent or legal guardian. The Academy may require a health or fitness disclosure prior to participation in certain programs.


modifications to these terms

The Academy may update these Terms, the Cancellation & No-Show Policy, or its pricing from time to time. Material changes will be communicated to active Clients in advance. Continued participation in Academy programs after such changes take effect constitutes acceptance of the updated Terms. Clients with an active package or subscription at the time of a change will have any fee-related changes applied prospectively, not retroactively, to sessions already purchased.


governing law

These Terms shall be governed by and construed in accordance with the laws of the Province of Alberta, Canada. Any disputes arising out of or relating to these Terms shall be resolved exclusively in the courts located within Alberta.

severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be severed from these Terms, and the remaining provisions shall continue in full force and effect as though the invalid provision had never been included.


entire agreement

These Terms, together with the Waiver and Release of Liability and the Cancellation & No-Show Policy, constitute the entire agreement between the parties with respect to their subject matter and supersede any prior or contemporaneous agreements, whether written or oral.

acceptance of terms

By purchasing a session, package, or subscription, or by participating in any Academy program, the Client acknowledges that they have read, understood, and agree to these Terms and Conditions.
