Waiver

This Waiver and Release of Liability ("Waiver") is executed by the undersigned participant (or the legal guardian of the participant, if under 18 years of age) in favour of SC10 Academy (the "Academy"), including its directors, officers, employees, coaches, volunteers, agents, and representatives (collectively, the "Released Parties").

Acknowledgment of Risks

I, the undersigned, acknowledge and understand that participation in soccer training, fitness programs, and related physical activities provided by the Academy involves inherent risks. These activities may include, but are not limited to:

  • Soccer drills and gameplay

  • Sprinting and speed training

  • Jumping and plyometric exercises

  • Agility and coordination training

  • Resistance and strength conditioning programs

  • Activities conducted at the Academy's gym facility, outdoor training grounds, and off-site locations

I acknowledge that these activities involve risks of physical injuries, including but not limited to muscle strains, ligament tears, fractures, concussions, cardiac events, or, in rare cases, permanent disability or death. I further acknowledge that these risks may result from my own actions, the actions of other participants, or the condition of the equipment, facilities, or environment.

Assumption of Risks

I voluntarily and knowingly assume all risks associated with participation in the activities provided by the Academy. I confirm that I (or my legal guardian, if under 18 years of age) have consulted with my physician, where necessary, and I am physically and mentally fit to participate in such activities.

Release of Liability

In consideration of being permitted to participate in the activities provided by the Academy, I, on behalf of myself, my heirs, executors, administrators, and assigns, hereby release, discharge, and hold harmless the Released Parties from any and all claims, demands, causes of action, damages, or liabilities of any kind arising out of or connected with my participation, including but not limited to claims based on negligence or gross negligence.

Authorization for Medical Treatment

I authorize the Academy and its representatives to obtain emergency medical treatment on my behalf (or on behalf of my child, if under 18 years of age) in the event of injury, illness, or accident during participation. I agree to accept full financial responsibility for any medical services rendered.

Payment Authorization (Cancellation & No-Show Policy)

I acknowledge that I have read and agree to the Academy's Cancellation & No-Show Policy, which is incorporated into this Waiver by reference. I authorize the Academy to charge the credit card provided at booking, or on file with the Academy, for any late cancellation fees, no-show fees, or other charges arising under that policy, without requiring a separate signature or authorization at the time each charge is applied.

Authorization of Media Rights

I grant the Academy the perpetual and irrevocable right to use photographs, videos, or other media recordings of me (or my child) taken during Academy activities for promotional, educational, or other lawful purposes. I waive any rights to royalties or compensation for such use and any rights to inspect or approve the final materials.

Code of Conduct

I agree to abide by the Academy's Code of Conduct, which emphasizes respect for coaches, staff, participants, and facilities. I understand that failure to comply with the Code of Conduct may result in disciplinary action, including suspension or removal from the program without a refund.

I acknowledge that the Academy does not provide personal accident, health, or medical insurance coverage. I affirm that I have sufficient insurance coverage or financial resources to cover any costs arising from injury or illness incurred during participation.

Facility Usage and Equipment

I agree to use the Academy's facilities, or associated facilities, equipment and resources responsibly and in accordance with any provided instructions or guidelines. I understand that misuse or failure to follow instructions may result in injury or damage, for which I may be held financially responsible.

Governing Law and Jurisdiction

This Waiver shall be governed by and construed in accordance with the laws of the Province of Alberta, Canada. Any disputes arising out of or relating to this Waiver shall be resolved exclusively in the courts located within Alberta.

If any provision of this Waiver is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be severed from this Waiver, and the remaining provisions shall continue in full force and effect as though the invalid provision had never been included.

entire agreement

This Waiver constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes any prior or contemporaneous agreements, whether written or oral. No amendment to this Waiver shall be valid unless made in writing and signed by both parties.

Acknowledgement of Understanding

I have carefully read and fully understand this Waiver. I acknowledge that I am signing it freely and voluntarily, with full knowledge of its legal significance. By signing this Waiver, I intend to release and indemnify the Released Parties to the fullest extent permitted by law.
